1. Overview

This website is operated by Bon Vivre LLC (“Bon Vivre,” “we,” “us,” or “our”).

These Terms of Service govern your use of www.bonvivre.us and purchases of our products and services. They incorporate our Refund Policy and Delivery Policy. Our Privacy Policy explains how we handle personal information.

Please read these terms before ordering. By placing an order or booking a service, you agree to the terms and policies presented to you at that time.

Our online store is hosted on Shopify.

2. Purchasing and Account Information

You must be legally able to enter into a purchase agreement or have permission from a parent or guardian who is responsible for the purchase.

Provide accurate and current contact, billing, delivery, and appointment information. You are responsible for protecting any customer account credentials.

If an address or other detail is incorrect, contact info@bonvivre.us promptly. We cannot guarantee changes after fulfillment has begun.

3. Products, Availability, and Descriptions

Bon Vivre offers locally sourced food, apparel, prairie seeds, gardening products, educational materials, and garden services as listed on our website.

Availability may change. Product listings describe the quantities, options, and services included in each purchase.

Natural products can vary in appearance, size, and composition. Beef cut selections and seed mixes may vary only as disclosed in the applicable listing. Product images may illustrate an offering; the written description identifies what is included.

We will contact you before making a material substitution that is not already authorized by the listing.

Device displays can affect how apparel colors appear.

4. Pricing and Orders

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes and delivery or shipping charges are displayed at checkout.

Prices may change for future purchases. We will not add charges to an accepted order without your agreement.

We may decline or cancel an order because of unavailable inventory, suspected fraud, delivery restrictions, or a material listing or pricing error. If this happens, we will notify you and refund any payment collected for the canceled items.

An order confirmation acknowledges receipt of your order. It does not guarantee fulfillment of an unavailable or incorrectly listed item.

5. Local Beef Delivery

Local beef delivery is available within 30 miles of Lake Charles, Louisiana, for $20 per delivery.

Order by Friday at noon for Saturday delivery. Arrival times vary throughout the day based on our route; a specific arrival time is not guaranteed.

Your beef arrives frozen.

Someone must be available to receive the order unless you leave a clean, insulated cooler with ice or frozen ice packs and enough room for your purchase.

Place the cooler somewhere visible and accessible, and include its location in your order notes.

We will not leave beef unattended in a box or outside a suitable cooler.

Refrigerate or freeze your beef promptly after delivery.

If nobody is available and no suitable cooler is provided, we will retain your order and contact you to arrange pickup or delivery on the next scheduled route. Redelivery requires an additional $20 delivery fee, agreed with you before scheduling.

If you are outside our delivery area, contact us before ordering to discuss whether pickup is possible. Beef shipping is not currently available.

If weather, road conditions, or another disruption prevents delivery, we will contact you to arrange the next steps.

6. Food Handling and Product Issues

Inspect food purchases when they arrive and follow package instructions for storage, thawing, and preparation.

If your order is incorrect, packaging is damaged, or food appears compromised, contact info@bonvivre.us promptly. Include your order number, a description, and photos when possible.

Do not consume food you believe is unsafe.

Perishable food cannot be returned, but an incorrect, damaged, or unsatisfactory order may qualify for a replacement or refund following review under our Refund Policy.

7. Garden Consultations and Build-Outs

The Initial Garden Consultation includes a one-hour, on-site visit as described in its product listing.

Service-area eligibility must be confirmed before an appointment is finalized. Please contact us before purchasing if you are unsure whether we serve your location.

You must have permission to provide access to the property. Tell us about relevant access restrictions or known hazards before the visit.

Consultations provide practical recommendations based on the information and conditions available at the time. Garden outcomes depend on weather, soil, pests, maintenance, and other factors. We do not guarantee a particular harvest or yield.

Materials, bed construction, installation, ongoing maintenance, and additional visits are included only when expressly stated in your purchase or written agreement.

Garden build-outs require an agreed scope and quote. Any changes to the work or price must be agreed before the additional work begins.

Consultation Cancellations

Cancel at least 24 hours before your appointment to receive a full refund.

Cancellations made less than 24 hours before the appointment are subject to a $50 cancellation fee. Any remaining prepaid balance will be refunded to your original payment method.

If Bon Vivre cancels your appointment, you may choose to reschedule or receive a full refund.

8. Seeds, Plants, and Gardening Products

Follow the instructions supplied with seeds, plants, and gardening products.

Germination, establishment, and plant growth depend on species, storage, planting conditions, weather, and ongoing care. We do not promise that every seed will germinate or guarantee a particular planting outcome.

Any stated product specifications or express guarantees remain applicable.

Contact us if a product arrives incorrect, damaged, or defective.

9. Digital Materials and Educational Content

Digital purchases include only the files, access, and materials identified in the listing. No physical item is shipped unless expressly stated.

Unless a listing provides a different license, purchased materials are for your personal or household use. You may print copies for that use, but may not resell, publicly upload, or distribute the files without written permission.

Downloaded digital products are not eligible for change-of-mind returns. Contact us if you receive the wrong file or experience an access or file problem.

Our educational content provides general information. It does not replace individualized medical, legal, or other professional advice, and does not guarantee health, athletic, financial, or gardening results.

Future programs or software are not included in a purchase unless expressly identified in that offer.

10. Returns, Exchanges, and Refunds

Our Refund Policy governs eligible returns and refunds.

Eligible merchandise may be returned within 30 days of receipt, subject to its condition requirements and prior approval.

Customers pay return shipping for change-of-mind returns, including size or color preferences. If we provide a label, we will confirm its actual cost before issuing it and deduct that agreed cost from the refund.

Bon Vivre covers required return shipping when we send the wrong item or an item arrives damaged or defective.

Approved refunds are issued to the original payment method within 10 business days. Your payment provider may require additional processing time.

11. Website Content and Intellectual Property

Website text, branding, designs, photos, and educational materials belong to Bon Vivre or their respective owners.

You may browse the site, share links, and use purchased materials within their stated license. Other reproduction, redistribution, or commercial use requires permission from the rights holder.

Nothing in these terms restricts uses permitted by applicable law.

12. Reviews, Feedback, and Photos

Submit only content you have permission to share. Do not post unlawful, misleading, abusive, or privacy-infringing material.

When you submit a review for public posting, you permit us to display it with the name or attribution you provide. We may make minor formatting edits without changing its meaning.

Private customer-service messages and garden photos do not automatically become public marketing content. We will ask permission before using identifiable private photos or testimonials in marketing.

We may remove submissions that violate these terms.

13. Third-Party Services and Links

Our website may link to farms, social media platforms, payment services, and other third-party websites.

Separate transactions with those businesses are governed by their own terms and policies. A third-party link does not make Bon Vivre responsible for that website’s operations.

This does not reduce our responsibility for products or services you purchase directly from Bon Vivre.

14. Acceptable Use

You may not use our website to:

• Commit fraud or other unlawful acts

• Submit false purchase or account information

• Infringe intellectual property or privacy rights

• Harass or threaten others

• Introduce malware or disrupt website operations

• Access accounts or systems without authorization

We may restrict access when reasonably necessary to address misuse, security threats, or violations of these terms. Restrictions do not eliminate any refund or other rights you have under applicable law.

16. Website Availability and Responsibility

We work to keep the website accurate and available, but technical interruptions and errors can occur. Contact us if you encounter an issue affecting your order.

Nothing in these terms excludes mandatory consumer protections, applicable product warranties, or liability that cannot lawfully be excluded or limited.

In particular, these terms do not exclude or limit liability for physical injury or damage caused by intentional or gross fault where prohibited by Louisiana law.

17. Governing Law

These terms are governed by the laws of Louisiana and applicable federal law, subject to any mandatory protections that apply to you.

18. Changes and Severability

We may update these terms and will publish the revised version with an updated date. Material changes apply prospectively unless otherwise agreed or required by law.

The terms applicable when your order was placed govern that purchase unless you agree to a change.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
